High Court clears Tobinco of fake drugs allegations

Tobinco Pharmaceuticals Limited (TPL) and its Group Chairman, Elder Dr Samuel Amo Tobbin, have been cleared of allegations of importing fake drugs into Ghana.

This ruling, delivered by Her Ladyship Audrey Kocuvie-Tay at the High Court, Accra, on July 29, 2024, contradicts claims made by former Chief Executive Officer of the Food and Drugs Authority (FDA), Dr Stephen Kwabena Opuni.

The legal battle began on July 19, 2019, when Tobinco Pharmaceuticals Limited filed a lawsuit against the FDA, accusing the authority of abusing its statutory powers and duties.

The company sought damages for the harm caused by the FDA’s actions. This was contained in a statement released by TPL on Sunday, August 11.

Background

The controversy dates back to between September and December 2013, when Dr. Kwabena Opuni, then CEO of the FDA, launched a series of actions against Tobinco Pharmaceuticals Limited. These actions were based on accusations that the company had imported fake drugs into the country.

As part of these measures, the FDA locked  Tobinco’s warehouses nationwide, leading to significant embarrassment for the company and its chairman. The regulator also disposed of Tobinco’s products, resulting in substantial financial losses as the products expired rapidly.

Additionally, the FDA banned Bliss GVS Pharma Limited, Tobinco’s principal business partner at the time, from exporting drugs to Ghana. This ban, coupled with the labeling of Tobinco’s drugs as fake, led to the confiscation of the company’s products from customers.

The situation escalated when Dr Opuni reported Elder Dr Tobbin to the Economic and Organised Crime Office (EOCO), leading to his arrest and detention at the Nima Police Station on December 2, 2013. This incident caused significant distress to his family, relatives, and employees.

Earlier, on September 13, 2013, operatives of the Bureau of National Investigations (BNI), now the National Intelligence Bureau (NIB), intercepted Elder Dr Tobbin and his partner, Mr Kamath, in a dramatic manner. They were detained and questioned for nearly an entire day without any charges being brought against them. The two were later required to report to the NIB office daily and were further questioned by National Security.

Tobinco Pharmaceuticals donates Ultrasound machine to Tema Polyclinic

The Maternity unit of the Tema Polyclinic can now breathe a sigh of relief because an ultrasound scanning machine has been put in place.

The top-of-the-line equipment, which was paid for in full by Tobinco Pharmaceuticals Limited in response to a request from the hospital’s management, will help lower the rate of maternal deaths.

According to the management of the Tema Polyclinic, the maternity unit of the facility, which has a daily visit of not less than 40 to 50 patients, has been under so much pressure for the past years due to its inability to run scans for pregnant women who visit the facility. 

According to them, this has contributed to low revenue generation because most pregnant women will choose other health facilities for their scan and antenatal over the Polyclinic, and in some cases, pregnant women during their antenatal will prefer to sit at home until their due date, which can be a major problem when it is their due date.

After the hospital’s management asked Tobinco Pharmaceutical Limited for help, the company gave the hospital a multi-purpose ultrasound scanning machine for its 60th anniversary.

Dr. Christopher Mensah, Deputy Managing Director-Marketing at Tobinco Pharmaceuticals Limited, said that while the company had supported the polyclinic’s anniversary celebrations, the donation of an ultrasound machine to the facility was to consolidate their existing relationship and to reiterate the values and tenets of Tobinco Pharmaceuticals Limited under the leadership of Elder Nana Amo Tobbin I.

Receiving the ultrasound machine on behalf of the hospital, the Medical Superintendent of the Polyclinic, Dr. Lenusia Ahlijah, who was beaming with smiles, could not hide her excitement at the gesture from Tobinco Pharmaceuticals.

She said the facility has been struggling for years now without a multi-purpose ultrasound scanning machine, adding that the support from Tobinco Pharmaceuticals Limited will not only help the facility generate more revenue but will also improve healthcare delivery at the polyclinic.

Tobinco Pharmaceuticals donates medicines to Ankaful Prisons

Tobinco Pharmaceuticals Limited donated over GH200,000 in medicines and food items to inmates at the Ankaful Maximum Security Prisons at Cape Coast in the Central Region.

The donation by the Executive Director of Tobinco Pharmaceuticals Limited, Mercy Araba Sika Tobbin, was to show love towards the inmates and also stock the prison health clinic with quality medicines from her outfit to curb the pressure of ailments among inmates.

The presentation to the Ankaful Maxim Security Prisons at Cape Coast forms part of the core mandate of Tobinco Pharmaceuticals Limited, which aims at giving back to society and also supporting the less privileged in the country.

The items include bags of rice and a variety of Tobinco pharmaceuticals medicines products among other items.

The Deputy Managing Director – Marketing at Tobinco Pharmaceuticals Limited, Dr. Christopher Mensah, was accompanied by the Deputy Managing Director – Operations, Lydia Owusu.

Dr. Christopher Mensah told Atinka TV that the idea was to show Christ’s love to the prisoners, especially in February, which is known as the month of love, to give the prisoners hope, and to help the weak and needy in society.

He added that the donation was a brainchild of the Executive Director of Tobinco Pharmaceuticals Limited, Mercy Araba Sika Tobbin, in support of the inmates in the area of health.

Supt. Vincent Ziniel, the Central Regional PRO for Ghana Prisons, praised the TPL for their generous contribution and urged other corporate organizations to join in to assist the government’s efforts to provide for the prisoners.

He added that each of the over 1,000 inmates only depends on one cedi eighty-eighty pesewas (1.80 p) a day, which is not enough, so there is a need for corporate institutions and individuals to support them.

Ankaful Maximum Security Prisons is the latest prison established in Ghana. It is the prison with the most modern prison facilities.
